Welcome to Havahavai, an AI-powered travel assistant app. By accessing or using our app, you agree to comply with and be bound by the following Terms and Conditions. Please review them carefully. If you do not agree with these terms, you must not use the app.
2. Definitions

Flight delay notifications.

6. User Responsibilities
When using our app, you agree:

Not to engage in fraudulent activities or misuse the app in any way.
To use the app only for lawful purposes.
7. Prohibited Activities
You agree not to engage in any of the following activities:
Access or attempt to access another user’s account without permission.
Disrupt or interfere with the security or functionality of the app.
Distribute malware, viruses, or any harmful code through the app.
Collect or harvest data from other users without their consent.
8. Payment and Fees
Certain services within the app may be subject to fees. You will be informed of such fees before any transaction is completed. All payments must be made through the methods available in the app, and you agree to pay all applicable charges in connection with your use of the services.
9. Intellectual Property
All content, trademarks, logos, and data presented in the app, including but not limited to text, graphics, user interfaces, and software, are the property of Havahavai or its licensors and are protected by intellectual property laws. You may not use, reproduce, or distribute any content from the app without our prior written permission.

The app may integrate or include third-party services, including airlines, travel providers, or payment gateways. We do not control or endorse third-party services and are not responsible for any issues or disputes arising from their use. Your use of third-party services may be subject to their respective terms and conditions.
11. Privacy and Data Usage
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our app, you agree to our data practices as outlined in the Privacy Policy.
Compliance with Gmail OAuth Policies
Selective Data Access: Havahavai accesses your Gmail data solely to read travel-related emails. We employ specific filters and criteria to ensure that only emails pertinent to travel (e.g., flight confirmations, booking receipts, itinerary updates) are accessed and processed. Non-travel-related emails are neither accessed nor stored by our application.
Data Usage for Generalized AI Models: We do not use your travel-related email data to develop, improve, or train generalized AI and/or ML models.
Data Retention: We retain your travel-related email data only for as long as necessary to provide the Services and improve personalized features. Upon termination of your account or at your request, we will delete your email data from our systems in accordance with our data retention policies.
Data Security: We implement appropriate technical and organizational measures to protect your data against unauthorized access, alteration, disclosure, or destruction.
User Control: You have the right to access, update, and delete your personal information. You can manage your data preferences through your account settings within the app. Additionally, you can opt-out of data usage for personalized AI features at any time through your account settings.
No Sharing with Third Parties for AI Training: We do not share your personal data, including email content, with third parties for the purpose of training AI or machine learning models. Data is used internally to enhance your personalized experience and is not utilized for developing generalized AI models.
User Consent: By granting access to your Gmail account, you consent to the use of your travel-related data for the aforementioned personalized AI functionalities. If you do not agree with this usage, you must not use the app or revoke access through your account settings.
Data Usage for Personalized AI: Our personalized AI uses your travel ticket data to train our personalized AI Model. This is to provide a better personalized experience. Data only in the ticket like Seat Number, Flight Number, Class Type (Economy/Business/etc.) are consumed for this purpose.
Delay Prediction: Our delay prediction AI model does not use any personal data and is trained on all the public data available through our partner APIs.
12. Limitation of Liability
To the fullest extent permitted by law, Havahavai and its affiliates, partners, and employees shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use or inability to use the app, including but not limited to loss of data, service interruptions, or any other damages or losses.
13. Disclaimer of Warranties
The Havahavai app is provided on an "as is" and "as available" basis. We do not guarantee that the app will be uninterrupted or error-free. To the extent allowed by law, we disclaim all warranties, whether express or implied, including but not limited to warranties of fitness for a particular purpose, non-infringement, and merchantability.
14. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective upon posting. We will notify you of any material changes, and your continued use of the app after such notification signifies your acceptance of the updated terms.
15. Termination
We may terminate or suspend your account or access to the app at our sole discretion, without notice or liability, if we believe you have violated these terms or engaged in unauthorized activities. Upon termination, your right to use the app will immediately cease, and we will delete your personal data in accordance with our data retention policies.
16. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of [Rajasthan, India]. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in [Rajasthan, India].
